Liability relating to the website, purpose of the website, terms and conditions of use
The purpose of the website is to provide current and future customers with transparent information about Sympany’s products and services and offer policyholders simplified access to Sympany’s services. Sympany strives to keep the content on the www.sympany.ch website as well as the subdomains win.sympany.ch, tourist.sympany.ch and my.sympany.ch (hereinafter “website”) up to date, complete and accurate. However, as this information may be subject to sudden changes, Sympany cannot make any guarantee with regard to the up-to-dateness, completeness and accuracy of the information. For definitive information, please refer to the binding offer we sent you and the applicable insurance provisions.
Sympany assumes no liability for any type of direct, indirect or consequential damages that may be incurred by users or third parties in relation to their access or use of the website, or for any disruptions caused by its use. The same also applies to pages accessed via links. Sympany does not check links to other websites and their content. Such content and links are provided solely for the purposes of user-friendliness and information. Sympany therefore assumes no liability for the products and services on such websites. Users access and make use of the services on offer at their own risk.
2. Intellectual property rights
All content on the website is protected by copyright and trademark laws. Downloading or printing parts of the website for private or internal use is permitted, provided that no legally protected names, designations, etc., are removed. The partial or whole use of the content in an electronic, written or another manner for public and/or commercial purposes is not permitted without the prior written consent of Sympany. Requests for approval are to be addressed to E-Mail. Any approval to use or download/print the website or parts thereof shall exclusively transfer and/or grant the rights the approval explicitly mentions.
3. Data protection
Sympany provides basic health, supplementary health, daily allowance, accident and indemnity insurance and undertakes with the data protection policy below to comprehensively implement legal data protection requirements and to continuously further develop data protection measures. Data protection is of vital importance for Sympany and forms a part of its responsibility on all levels:
- Sympany respects the privacy rights of potential customers, policyholders and employees. Privacy protection is a component of Sympany’s definition of quality.
- Sympany is committed to ensuring that all necessary HR, technical and organisational security measures are in place in order to guarantee data security.
- Sympany in particular ensures that, apart from data transferred for the purpose of sending the newsletter mentioned in this data protection policy, no customer data is disclosed to third parties for marketing purposes.
- Data is processed in accordance with Swiss data protection legislation. This is the case unless privacy policies of other companies apply (e.g. Facebook Inc., Google Inc., etc.), over which Sympany has no control.
- All Sympany employees are bound to confidentiality when working with personal data.
- Sympany is committed to raising awareness among employees and ensuring they have a sufficient level of expertise. Information is provided on a regular basis concerning the importance and implementation of data protection measures, and employees also receive proper training in this regard.
The Processing Regulations for Data Collection document of 13 June 2022 (in German) governs the details on how customer data is to be handled. Sympany works with its outsourcing partner, Centris AG, Solothurn, to process data in accordance with the DRG remuneration model. In accordance with relevant legal provisions, both Sympany and Centris AG, Solothurn, have been certified as DRG collection points by SQS (certificate Vivao Sympany AG, certificate Moove Sympany AG, certificate Kolping Krankenkasse AG; in German). Details on data processing are defined in a set of regulations.
4. Data collected by Sympany
Sympany collects, stores and uses the following general data, which is stored in log files:
- IP address
- General information about your operating system and browser
- Date, time and duration of your visit
- Visitor source (linking website)
This data is used to improve the website and mySympany customer portal and allows Sympany to offer the relevant online services. This data may also be processed for statistical analyses. If this data is processed via cookies, the conditions below apply as well.
By providing your data, you consent to us sharing it with a third-party service provider commissioned by us where this is required for the purposes of addressing issues you have raised online or over the phone or executing contracts. The service providers we work with are bound by the same data protection provisions as Sympany.
All data sent via forms on the Sympany website is transferred in encrypted form and cannot be viewed by third parties. The data entered by users and customers is used for the purpose of establishing contact, preparing offers, executing contracts and, if applicable, for marketing purposes within Sympany. By entering personal information into Sympany’s premium calculator, the users agree that Sympany can contact them by phone or in any other way. If you do not want to be contacted, you can inform us of this via the feedback form.
If you are already insured with Sympany, have submitted an insurance application or have sent us your contact information in connection with your desire to establish contact, we can link your data collected via the website or your login with new or existing personal data. In this case, the legal basis for the processing of personal data is the fulfilment of contractual obligations. Your consent and the legitimate interests of Sympany serve as a further legal basis for the processing of your personal data. You can revoke your consent at any point by sending an E-Mail.
Should third-party services be required to process a request of yours which was communicated online or by phone, or to process a contract, you consent when you enter your information that your data can be passed on to a provider contracted by us. Our service providers are subject to the same data protection provisions as Sympany.
Data entered by customers and/or provided by Sympany is used by Sympany to process insurance policies. This information can only be accessed by Sympany. By using the mySympany customer portal, you are consenting to us sharing your data with a service provider commissioned by us. You can revoke your consent to us sharing your data at any point by sending an E-Mail. You may find, however, that your use of mySympany is restricted as a result.
5. Chatbot and live chat
We use a chatbot on our website. The chatbot provides automated answers to your questions around the clock. You will sometimes be asked to enter personal details, including your first name, surname, date of birth, postcode, telephone number and e-mail address, so that we can send you a quote or call you back. Sympany has commissioned Enterprise Bot GmbH, Soodmattenstrasse 4, 8134 Adliswil, Switzerland to further process the data you provide.

6. Website analytics and cookies
Although the data collected by the cookies is collected and processed anonymously, you can also use the Sympany website without cookies by deactivating cookies in your browser. You can also activate an opt-out cookie for every external provider. It should be noted, however, that deactivating Sympany cookies may make certain features unavailable and also lead to restrictions in terms of your use of our website.
You can find details about the way third parties use your personal data in their respective privacy policies, e.g. those of Facebook, Google and Adobe Systems. Please note that Sympany’s data protection provisions do not apply to the processing of data by these third parties. As the provider of the website, Sympany does not have exhaustive knowledge of the content of the transferred data and the specific way it is used by third parties. By using the corresponding products, such as Facebook, Google, etc., you declare that you agree with the relevant privacy policies.

Sympany uses the services of Adobe Analytics to automatically collect data about the use of the websites and the mySympany customer portal when you visit them. Sympany uses this data to find out how the website is being used and gain insights into the surfing habits of the website users. The information generated by the cookie concerning your use of Sympany websites is transferred to an Adobe server and stored there.

Sympany uses the services of Google Analytics to automatically collect data about your use of the website when you visit it. Sympany uses this data to find out how the website is being used and to gain insights into the surfing habits of website users. The information generated by cookies concerning your use of the Sympany website is transferred to a Google server and stored there.
You can install a browser plug-in to deactivate Google Analytics.
Google Ads remarketing
Google Ads remarketing analyses your surfing habits and uses them as a basis for displaying personalised Sympany advertisements when you surf the Internet or use a mobile app or the Google search engine. In this way, interest-based, personalised advertisements tailored to you based on your earlier usage and surfing habits on one device (e.g. smartphone) can also be shown on another device (e.g. tablet or PC). With Google Ads, the advertisements placed on Google are analysed and paid for by Sympany.
If you have granted the corresponding consent, Google will link your online and app browser history with your Google account. This means that you will be shown the same personalised advertisements on any device you are signed into with your Google account.
Google DoubleClick for Advertisers and DoubleClick Floodlight
- If you do not have a Google account and do not want Google to collect usage data, you can deactivate personalised ads. This installs an opt-out cookie on your device.
- Please note: no usage data is collected as long as Google’s personalised ads are deactivated and a corresponding opt-out cookie has been installed.
- If you have a Google account, you can permanently object to cross-device remarketing/targeting by deactivating personalised advertising in your Google account.
To the extent that Sympany falls within the scope of the GDPR, collected data shall only be captured in your Google account on the basis of your consent. You can grant or revoke this consent from Google at any time (Article 6  [a] GDPR). For data collecting processes that are not captured in your Google account (e.g. because you do not have a Google account or have objected to this capture), the collection of the data shall be based on Article 6 (1)(f) GDPR. Sympany’s legitimate interest is based on its interest in the anonymised analysis of website visitors for advertising purposes.
Google reCAPTCHA v3
This page uses the map service Google Maps via an interface. To use the functions of Google Maps, it is necessary to store your IP address. This information is usually transferred to a Google server in the U.S. and stored there. Sympany has no say regarding the transfer of this data.
Google Maps is used for the purpose of displaying our online offers appealingly and to make it easy to find the locations we have provided on our website. This constitutes a legitimate interest within the meaning of Art. 6 (1)(f) GDPR.

Sympany uses Hotjar to gain a better understanding of its website users’ requirements and to optimise the offer and experience on this website. With the help of Hotjar’s technology, Sympany can improve its understanding of the user experience (e.g. how much time users spend on which pages, which links they click on, etc.).
Hotjar works with cookies and other technologies to collect data about website users’ behaviour and devices, particularly the device IP address (which is recorded and saved in anonymised form only while the user stays on the site), screen size, device type (Unique Device Identifiers), information about the browser used, location (country only) or the user’s preferred language for viewing the Sympany website. Hotjar stores this information in a pseudonymised user profile on Sympany’s behalf. Hotjar is contractually prohibited from selling the data it collects on behalf of Sympany.

7. E-mail communication
E-mail messages to Sympany are not encrypted and could be viewed by third parties. Sympany cannot guarantee data security for any unencrypted e-mails it receives and also rejects any warranty and liability for these.
Our newsletter is sent to our policyholders on the basis of the customer relationship. It is also sent to potential customers who have voluntarily given us their e-mail address, e.g. as part of a competition or offer, and have consented to Sympany using their data for marketing purposes and to establish contact. Existing and potential customers receive various newsletters containing information relating to Sympany that is of interest to them. You can unsubscribe to all newsletters and promotional e-mails at any time at the bottom of the e-mail. Your e-mail address will only be used to send information about Sympany. We transfer the related data to the following third party:

Information on user behaviour in newsletters is collected via the newsletter tool. Information on your habits with regard to clicking on hyperlinks in e-mails and websites is collected via the DoubleClick tracker, and a cookie is also installed on your device. Sympany reserves the right to continuously adapt and change the content of the website. This also applies to all content on the website and the terms and conditions set out here. Sympany rejects all liability for consequences arising from such changes. For all services offered by Sympany or affiliated companies, the current versions of the respective insurance provisions shall apply.
11. Severability clause
Should one or more provisions of these terms and conditions of use be or become ineffective, unlawful or non-enforceable, the validity of the other provisions shall not be affected.
12. Applicable law
Subject to deviating legally binding provisions, these terms and conditions of use shall be subject to Swiss law to the exclusion of any applicable international treaties or conventions. The exclusive place of jurisdiction for all disputes arising from or in connection with these terms and conditions of use shall be Basel.
13. Data Protection Officer, requests for information, contact
Any person may request information from Sympany as to whether and in what way data about them is processed. In addition, you may ask for your personal data to be corrected if there are any errors, in which case you may also request that its processing be restricted or that it be erased.
You also have the right to receive all personal data concerning you in a structured, commonly used and machine-readable format. These rights are described in greater detail in the Processing Regulations for Data Collection of 13 June 2022 (in German).
